Disgraced movie producer Harvey Weinstein is already serving a 23-year prison sentence, but now he’s heading back to trial. Following his February conviction of rape and sexual assault in New York, Los Angeles prosecutors have hit Weinstein with an additional sexual assault charge.

The Associated Press reports that the new charge was filed by the district attorney’s office over allegations he sexually assaulted a woman at a Beverly Hills hotel back in May 2010. The charge is for one count of felony sexual battery by restraint. Initially, the unnamed woman was interview by detectives as a corroborating witness during Weinstein’s lengthy trials, but in new info provided by her, it was revealed the alleged assault happened within the 10-year statute of limitations.

The charge has been added to his ongoing case in Los Angeles, which alleges that he sexually assaulted two different women on separate occasions in 2013. Prosecutors added that they will not prosecute two other cases involving the former producer as the women said they were not willing to testify against him. It is unclear when Weinstein will be transported from behind bars in New York to the trial in Los Angeles.

The news of the new charge comes less than a month after Weinstein reportedly tested positive for coronavirus. As of April 1, it was confirmed that he was recovering from the virus and was placed in isolation. He was sentenced to 23 years in prison in March for rape and sexual assault.
