{"id":127270,"date":"2022-04-06T23:23:10","date_gmt":"2022-04-06T23:23:10","guid":{"rendered":"https:\/\/freshestfm.com\/ed-sheeran-wins-copyright-lawsuit-over-shape-of-you\/"},"modified":"2022-04-06T23:23:19","modified_gmt":"2022-04-06T23:23:19","slug":"ed-sheeran-wins-copyright-lawsuit-over-shape-of-you","status":"publish","type":"post","link":"https:\/\/freshestfm.com\/ed-sheeran-wins-copyright-lawsuit-over-shape-of-you\/","title":{"rendered":"Ed Sheeran Wins Copyright Lawsuit Over \u201cShape of You\u201d"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><a target=\"_blank\" href=\"https:\/\/complex.com\/tag\/ed-sheeran\" rel=\"noopener\">Ed Sheeran<\/a>\u00a0came out victorious in his years-long legal fight over \u201cShape of You.\u201d<\/p>\n<p>In 2018, grime artist Sami Switch sued the British singer-songwriter for allegedly plagiarizing his 2015 song \u201cOh Why.\u201d The plaintiff claimed Sheeran and \u201cShape of You\u201d co-writers\u2014producer Steve Mac and\u00a0Snow Patrol\u2019s Johnny McDaid\u2014had stolen \u201cOh Why\u2019s\u201d\u00a0melody for\u00a0Sheeran\u2019s 2017 chart-topper. Switch and \u201cOh Why\u201d co-writer\u00a0Ross O\u2019Donoghue specifically pointed to the \u201cOh I\u201d phrase in \u201cShape of You,\u201d claiming it was very similar to portions of their song.<\/p>\n<p>The defendants denied the allegations and subsequently asked a UK court to declare they had not infringed on the copyright.<\/p>\n<p>On Wednesday, London\u00a0High Court Judge Antony Zacaroli rule\u00a0Sheeran\u00a0\u201cneither deliberately nor subconsciously\u201d copied \u201cOh Why\u201d when he wrote \u201cShape of You\u201d in 2016. According to the <a target=\"_blank\" href=\"https:\/\/www.bbc.com\/news\/entertainment-arts-61008849\" rel=\"noopener\">BBC<\/a>, Zacaroli told the parties there were clear similarities between the songs, but\u00a0\u201csuch similarities are only a starting point for a possible [copyright]\u00a0infringement.\u201d He went on to say there were \u201cdifferences between the relevant parts\u201d of the songs, which \u201cprovide compelling evidence that the \u2018Oh I\u2019 phrase\u00a0in \u201cShape of You\u201d had\u00a0\u201coriginated from sources other than \u201cOh Why.\u201d<\/p>\n<p>Shortly after the judge announced the verdict, Sheeran took to social media to address case.<\/p>\n<section class=\"suitcase-ad\" \/>\n<p>\u201cWhile we\u2019re obviously happy with the result, I feel like claims like this are way too common now and have become a culture where a claim is made with the idea that a settlement will be cheaper than taking it to court,\u201d he said in a video message.\u00a0\u201cEven if there\u2019s no base for the claim. It\u2019s really damaging to the songwriting industry. There\u2019s only so many notes and very few chords used in pop music. Coincidence is bound to happen if 60,000 songs are being released every day on Spotify.\u201d<\/p>\n<p>He continued: \u201cI don\u2019t want to take anything away from the pain and hurt suffered by both sides of this case, but I just want to say that I\u2019m not an entity. I\u2019m not a corporation. I\u2019m a human being. I\u2019m a father. I\u2019m a husband. I\u2019m a son. Lawsuits are not a pleasant experience and I hope with this ruling it means in the future baseless claims like this can be avoided.\u201d<\/p>\n<p>\u201cShape of You\u201d was the second single off Sheeran\u2019s third studio album,\u00a0<em>\u00f7 (Divide)<\/em>.
